Terms & Conditions: Brand in Box Design Service

These Terms govern your use of and engagement with the Brand in Box design service provided by HiART Media. By purchasing or interacting with this product, you agree to the following terms:


1. Definitions & Scope

“Brand in Box” refers to a packaged branding service including logo design, brand identity assets, and supporting materials delivered as per the defined offering.


2. Services & Deliverables

The package includes (but is not limited to):

  • Logo design (primary + secondary marks)
  • Brand style guide (typography, colors, usage rules)
  • Social media templates or mockups
  • Optional add-ons (e.g. packaging, web design templates)

Revisions

  • Up to [2] rounds of revisions are included.
  • Additional revisions beyond scope are billed separately at 70$ per hour or per deliverable.

3. Timeline & Work Schedule

  • Work begins once deposit is received and onboarding questionnaire is completed.
  • Estimated project timeline: [e.g. 2-5 weeks]
  • Client is expected to reply within 3 business days per feedback round to avoid delays.

4. Free Brand Audit (Optional Pre-Service)

We offer a complimentary brand audit to evaluate your existing logo and brand identity before starting.

  • The audit includes:
    • Assessment of visual consistency and design quality
    • Analysis of logo scalability, typography, and brand alignment
    • A concise rebranding advice report
  • This audit is non-binding and does not oblige the client to proceed with the service.
  • The audit and recommendations remain the property of the Designer until a full service agreement is made.

5. Booking & Contact Process

  • Clients may book a discovery call or free audit through the official website calendar or contact form.
  • Appointments are confirmed via email and are subject to availability.
  • Communication is handled via email or project management tools (e.g., Trello, Notion, or Google Docs), as agreed.
  • Response time: typically within 1–3 business days.

6. Fees & Payment Terms

  • Pricing is fixed per package unless custom work is requested.
  • 50% deposit due upfront; 50% balance due before delivery of final files.
  • Payment accepted via [e.g., PayPal, bank transfer].
  • Late payments accrue interest at 10% monthly.

7. Cancellation & Refund Policy

Client-Initiated Cancellation

  • Within 48 hours of purchase and before design begins: Full refund minus payment fees.
  • After work begins: Deposit is non-refundable.
  • If canceled after initial concepts are delivered:
    • Partial refund (up to 50% of remaining balance) based on completed work.

HiART Media-Initiated Cancellation

  • If canceled by HiART Media due to unforeseen events, a pro-rated refund will be issued for incomplete work.

Project Abandonment

  • If the Client fails to communicate for 14 consecutive days, the project is considered abandoned, and no refund is due.

8. Intellectual Property & Licensing

  • All rights to pre-existing design assets or templates remain with the HiART Media.
  • Final deliverables are transferred to the Client upon full payment.
  • HiART Media retains rights to showcase work in portfolios, unless otherwise agreed in writing.

9. Client Responsibilities

  • Provide accurate brand information, images, and timely feedback.
  • Ensure all shared content is owned by the Client or appropriately licensed.
  • Maintain professional, respectful communication throughout the project.

10. Warranties & Limitations

  • HiART Media warrants all custom deliverables are original and free of copyright infringement.
  • No guarantees are made regarding business outcomes or third-party platform results (e.g., sales, reach).
  • HiART Media’s liability is limited to the total amount paid by Client.

11. Governing Law & Dispute Resolution

  • These terms are governed by the laws of Yemen.
  • Disputes shall be resolved via mediation before legal action is taken.
  • Jurisdiction: Courts of Yemen.

12. Changes & Interruptions

  • Timeline adjustments may occur due to Client delays, HiART Media incapacity, or force majeure.
  • Clients will be notified promptly of any major interruptions.

13. Agreement

By purchasing or engaging with the Brand in Box service, the Client confirms they have read, understood, and agreed to these Terms.
